President Bola Tinubu, vice president Kashim Shittema and the All Peoples Congress (APC) on Wednesday closed their defence in Mr Peter Obi and his Labour Party’s petition. Counsel for Tinubu and Shettima, Wole Olanipekun, SAN informed the presidential election petition court (PEPC) that they are closing their case after the testimony of their sole witness.

President Bola Tinubu flanked by VP Kashima Shettima and supporters Lateef Fagbemi, SAN for APC also informed the court that they have no witnesses and relied on the witnesses called by other respondents. Following the closure of their defence the five-member panel presided over by Justice Haruna Tsammani said the date for the final written addresses would be communicated. Tsammani assigned 10 days each to the respondents, seven days to the petitioners and five days for reply. Earlier, Tinubu through his counsel tendered some documents in support of their defence. The documents tendered are a letter from the Nigeria Police to the United States Embassy, dated February 3, 2003; letter from the United States Embassy to the Nigeria Police, dated February 4, 2003. Others are; US Visas and immigration documents between 2011 and 2021.
Others are; A copy of the Report of the Committee on the Location of the Federal Capital of Nigeria, certified by the Archives and History Bureau of the FCT. Tendered also are copies of Form EC 8D for Kano State in respect of the February 25, 2023, presidential election; and copies of Form EC 8D(A); copies of Form EC8D in respect of the presidential election of 25th February 2023. Also tendered and admitted were a list of registered members of the labour party and a membership list of LP for Anambra state to claim that Obi is not a member of the labour party. After the tendering of documents, Olanipekun called their sole witness, Senate Majority Leader Sen. Michael Bamidele to testify. Being cross-examined by Fagbemi, the witness told the court that the February 25 presidential election results for APC in Kano state were recorded with a shortfall of 10, 292 votes against Tinubu. He added that Obi‘s name was not contained in the membership list of the LP submitted to the INEC. Being cross-examined by counsel to Obi, Dr Livy Uzoukwu, SAN the witness agreed that there a report by the EU election observers in Nigeria and it was tendered through him in evidence. On whether the letter from the United States Embassy to the Nigeria Police, dated February 4, 2003 addresses issues of criminal allegation against Tinubu, the witness said the Nigeria Police letter to the US requested for search for general Criminal records against Tinubu.. He added that therefore the US letter which cleared Tinubu of criminal conviction was an appropriate response. Uzoukwu made this comment on Monday, shortly after the court adjourned its resumed sitting, following the absence of INEC’s first defence witness.

The Presidential Election Petition Court (PEPC) on Saturday dismissed the application filed by the Labour Party and Mr Peter Obi seeking an order to question INEC on the technology it deployed for the conduct of the general elections. Ruling on the application, the five-member panel led by Justice Haruna Tsammani held that it lacked the jurisdiction to grant the request as it was brought outside the pre-hearing session and therefore incompetent. “It is an afterthought on the grounds that the pre-hearing period to file such an application elapsed on May 22. “I have not disputed the fact that they did not call the attention of the court during the pre-hearing session.”
“It is for the applicant to take a step towards the hearing of his motion on notice. The court cannot do that for him. “The petitioners’ counsel are very conversant with the provisions of the law and did not ask for an extension of time. ” They rather seek to employ the right to fair hearing as a magic wand to escape the consequence of their failure to comply with the law and blame the court for its inaction” the court held. The court also held that the applicants failed to disclose any extreme circumstance that stopped them from filing within the statutory time. In a unanimous decision, the court stated that motions cannot be heard at the hearing session and as such can be deemed as abandoned. ”Their application is incompetent and the court lacks the jurisdiction to entertain it and accordingly, the application is struck out.” It held. The petitioners, among other reasons for disputing the outcome of the elections are accusing the electoral umpire of non-compliance with the Electoral Act. Their concerns also included failure to transmit the results of the presidential election in real-time on the INEC results viewing portal as assured. In their effort to support the grounds of their petition, the petitioners had asked the court to permit them to question INEC. on the technology deployed to conduct the election including the quality of the ICT experts who oversaw the conduct of the election. In two applications, the petitioners through their lawyer, Patrick Ikweto, SAN, urged the court to order INEC to supply the names and other details of its ICT professionals that deployed electronic devices for the conduct of the election. Specifically, the petitioners maintained that given INEC’s reply to their petition, it should be compelled to answer 12 questions posed to them. The family of deceased Nollywood thespian, Saint Obi, reacts to viral reports that he had suffered in his marriage prior to his death. A reports by one Mr Zik Zulu Okafor had described how the movie star had suffered maltreatment from his wife’s family before he died.

In a lengthy disclaimer, the family stated that the reports were simply false and malicious. Dissociating themselves from it, the family described Mr Okafor’s article as sad and unfortunate, emphasizing that the family is still morning and would like their privacy to be respected by all. The ultimatum was given on Friday, May 12, after Apapa convened a parallel meeting of the National Executive Council of the party in Bauchi state.

Let me clarify: I know the entity known as Peter Obi, presidential candidate of the Labour Party. I can relate to him. I know and can relate to the Labour Party on whose platform he contested elections. There are simply no issues to reconcile between those two entities and myself. However, I do not know, and I am unable to relate to something known as the “Obidient” or “Obidient Family”. Thus, albeit in a different vein, any notion of Reconciliation, or even relations – positive, negative or indifferent – with such a spectral emanation is simply grasping at empty air.

During that meeting, attended by two other individuals only, the word “Reconciliation” was never bruited, neither in itself nor in any other form. It simply did not arise. By contrast, there were expressions of “burden of leadership” “responsibility”, “apology”, “pleading”, “formal dissociation from the untenable”, all the way to the “tragic ascendancy of ethnic cleavage”, especially under such ironic, untenable circumstances. Discussions were frank, and creative. The notion of Reconciliation was clearly N/A – None Applicable. It was never raised. The following should be understood, but never underestimated. What remains ineradicable from that weekend of orgiastic rave in the social media was the opening up of the dark, putrid recesses in the national psyche that we like to pretend do not exist. It invited – into minds seeking a grasp on reality – gruesome variations on images from Dante’s Purgatorio. A fathomless pit was exposed, at the bottom of which one glimpsed a throng of the damned, writhing in competitive lust for the largest of the gangrenous ladles in a diabolical broth. To peek over the edge of that pit for a prolonged spell was to turn giddy, with a risk of falling into the tureen of inhuman pus. To attempt to navigate one’s way, however gingerly, along a mat spread across the infernal abyss, is an invitation to moral suiciiide. “For the serious minded, I call attention to essays I have offered on the theme of Reconciliation based on Truth, and the ethical imperative of Restitution.
