Court orders immediate release of Emefiele Court declares the arrest and ongoing detention of the former Governor of the Central Bank of Nigeria, Godwin Emefiele by the Department of State Services (DSS) as invalid. This ruling comes one day after a Federal Capital Territory High Court in Abuja ordered Emefiele’s release.
Suspended Governor of the Central Bank of Nigeria, Godwin Emefiele. Emefiele had sought the court’s intervention against several parties, including the Forum for Accountability and Good Leadership, the Attorney General of the Federation, the Economic and Financial Crimes Commission (EFCC), the Inspector General of Police, the State Security Service, and the Central Bank of Nigeria. Justice Kawu concluded that Emefiele’s arrest and detention were in violation of a previous ruling made by Justice M. A. Hassan. Emefiele’s lawyer, Peter Abang, urged the court to invalidate his client’s arrest and detention, asserting that it disregarded Justice Hassan’s ruling issued on December 29, 2022. Justice Bello Kawu concurred that the arrest and detention were contrary to Justice Hassan’s standing order. The court also invalidated any arrest warrant obtained by the DSS and ordered Emefiele’s immediate release from custody. In response to the ruling, Emefiele’s legal counsel commended the bravery of Nigerian judges and urged the DSS to promptly comply with the court order. He emphasized that Emefiele’s health had deteriorated during his one-month detention and insisted that he should be allowed to attend to it.
Tinubu signs 3 Executive Orders, suspends Green Tax
President Bola Tinubu has signed three executive orders to ameliorate the negative impacts of tax adjustments on businesses and households across affected sectors. Mr Dele Alake, Presidential Adviser on Special Duties, Communications and Strategy, made this known at a briefing on Thursday in Abuja.
The new orders affected the Finance Act 2023, the Customs, Excise Tariff and the Excise Tax on telecommunications as well as the Green Tax. “The Finance Act (Effective Date Variation) Order, 2023, has now deferred the commencement date of the changes contained in the Act from May 23, 2023 to September 1, 2023. This is to ensure adherence to the 90 days minimum advance notice for tax changes as contained in the 2017 National Tax Policy. “The Customs, Excise Tariff (Variation) Amendment Order, 2023. This has also shifted the commencement date of the tax changes from March 27, 2023 to August 1, 2023 and also in line with the National Tax Policy. “The President has given an Order suspending the 5% Excise Tax on telecommunication services as well as the Excise Duties escalation on locally manufactured products. “Further to his commitment to creating a business-friendly environment, the President has ordered the suspension of the newly introduced Green Tax by way of Excise Tax on Single Use Plastics, including plastic containers and bottles. “In addition, the President has ordered the suspension of Import Tax Adjustment levy on certain vehicles,” he said. Tinubu said that the review was part of his administration’s resolve to ease the lives of Nigerians and encourage corporate entities in spite of obvious challenges. The president said that the reviewed tax were part of those signed in the twilight of the last administration. “You will all recall that prior to the advent of this Administration, certain tax changes were introduced via the Customs, Excise Tariff (Variation) Amendment Order, 2023 (henceforth referred to as “the Order”) published on May 8 and the Finance Act, 2023, which was signed into law on May 28. “Among others, the Order introduced new Excise Duty on Single Use Plastics (SUPs), higher Excise Duties on some locally manufactured products, including alcoholic beverages and tobacco products, and Green Tax by way of Import Tax Adjustment on certain categories of imported vehicles. “The Tinubu Administration has since noticed that some of the tax policies are being implemented retroactively with their commencement dates, in some instances, pre-dating the official publication of the relevant legal instruments backing the policies. This lacuna has created some challenges of implementation.” He said that the ideas behind upward adjustments of some of these taxes are quite noble because they were designed to raise revenue as well as address environmental and health issues of concern. “However, they have generated some significant challenges for, and elicited serious complaints amongst key stakeholders as well as in the business community. “A document known as the 2017 National Tax Policy approved by the Federal Executive Council of the last administration prescribes a minimum of 90 days notice from government to tax-payers before any tax changes can take effect. “This global practice is done with a view to giving taxpayers and businesses reasonable time to adjust to the new tax regime. “However, both the Finance Act 2023 and the Customs, Excise Tariff Order 2023 did not give the required minimum notice period, thus putting businesses in violation of the new tax regime even before the changes were gazetted. “As a result of this, many affected businesses are already contending with the rising cost, falling margins and capacity underutilisation due o various macroeconomic headwinds as well as the impact of Naira redesign policy.” He stated that the Excise Tax increases on tobacco products and alcoholic beverages from 2022 to 2024, which had already been approved, are also being implemented. “But a further escalation of the approved rates by the current administration presents an image of policy inconsistency and creates an atmosphere of uncertainty for businesses operating in Nigeria. “The Excise Tax of fiver per cent on telecommunication services has generated heated controversy. “There is also a lack of clarity regarding the status of this tax, just as players in the sector also complain about the imposition of multiple taxes on their operations. “We have also seen that the Green Taxes, including the Single Use Plastics tax and the Import Adjustment Levy on certain categories of vehicles require more consultation and a holistic approach to the country’s net zero plan in a manner that does not impact the economy negatively.” The News Agency of Nigeria (NAN) report that in his inaugural speech, Tinubu promised to address business unfriendly fiscal policy measures and multiplicity of taxes. These new orders were issued to ameliorate the negative impacts of the tax adjustments on businesses and chokehold on households across affected sectors. Tinubu reiterated his commitment to reviewing complaints about multiple taxation, local and anti-business inhibitions. “The Federal government sees business owners, local and foreign investors as critical engines in its focus on achieving higher GDP growth and appreciable reduction in unemployment rate through job creation. “The government will, therefore, continue to give requisite stimulus by way of friendly policies to allow businesses to flourish in the country.” He assured Nigerians that there would not be further tax raise without robust and wide consultations undertaken within the context of a coherent fiscal policy framework.
Court orders Police to pay rtd AIG Mbu N40m for unlawful retirement
The National Industrial Court on Monday ordered the Police Service Commission ( PSC), to pay retired AIG Mbu Joseph Mbu, the sum of N40 million as general damages. The payment as ordered by Justice Osatohanmwen Obaseki-Osaghae, was for the unlawful retirement of Mbu before he attained the mandatory age of 60 years.
RTD AIG Mbu Joseph Mbu ” I hold that the claimant’s premature retirement through a press release on July 2, 2016, is unlawful, unconstitutional, null and void and of no effect”. The court in addition set aside the purported retirement and declared that the claimant remained an officer of the Nigeria Police Force ( NPF) until he attained the mandatory retirement age of 60 on May 10, 2018. Furthermore, the court ordered the defendant to pay Mbu his salaries, allowances and entitlement from July 2, 2016, when he was retired until May 10, 2018, when he ought to have retired having attained 60 years. The judge while delivering the judgment ordered that the sum of N750,000 be paid to the claimant as cost of the suit, stating that failure of the defendant to comply with the orders of the court within 30 days will attract a 10 per cent interest per annum. The court, however, declined the relief of promotion to the position of a DIG and reinstatement sought by the claimant. This, the court explained cannot be sustained as the claimant had reached the mandatory retirement age on May 10, 2018, when the suit was pending. From facts, the claimant, Mbu instituted the suit against the commission over his alleged compulsory retirement on July 2, 2016, when he was the commandant of the Police Staff College. In his statement of facts, he stated that he was born May 10, 1958, and joined the police on Dec. 11, 1985, and had not reached the mandatory retirement age of 60, nor had he spent 35 years in service before he was retired in 2016. The claimant had therefore sought, amongst other reliefs, an order of the court to invalidate his retirement, which he claimed was done via a press release as he was never served statutory notice of retirement. He also sought for an order of the court directing the defendant to pay his salaries, allowances and other entitlements from July 2016 to 2018, when he would have been due for retirement. He also sought for payment of his terminal benefits, N500 million as general damages and N20 million as the cost of the suit. The defendant on its part through processes stated that the claimant was not retired through press release, but that he was pulled out from the force in a ceremonial event. The defendant equally averred that promotion in the force is not automatic and that the claimant did not meet some of the requirements for promotion. According to the defendant, the reorganisation in NPF at the time of the claimant’s retirement followed due process and the claimant was not the only person affected. The court in its judgment stated that although the defendant abandoned its case by failing to show up in court to conduct its defence, the action did not exonerate the claimant from the burden to prove his case. The judge submitted that pleadings are not synonymous with evidence as the defendant was never in court regardless of several hearing notices served. Obaseki-Osaghae in addition stated that the defendant was deemed to have abandoned its case as the claimant’s submissions were not contested. She said that the claimant having proven his case on its strength through credible evidence without relying on the weakness of the defendant, was entitled to some of the reliefs he sought.
Mother orders son to shoot man during argument at fast-food-joint
In Chicago, a distressing incident unfolded at a fast-food joint, resulting in the death of a man and the subsequent arrest of a 14-year-old son and his mother. The altercation took place at Maxwell Street Express when an argument erupted between 35-year-old Carlishia Hood and 32-year-old Jeremy Brown. During the heated exchange, Carlishia reached out to her teenage son, who was waiting in the car. Report revealed that as the argument escalated, Jeremy resorted to physically assaulting Carlishia, repeatedly striking her head with force. In response to witnessing his mother’s assault, the 14-year-old retrieved a firearm and shot Jeremy in the back. Attempting to escape, Jeremy fled the restaurant, but the young teenager pursued him outside, firing additional shots. Tragically, Jeremy sustained two gunshot wounds to his back and later succumbed to his injuries at the hospital. Following the incident, Carlishia and her son turned themselves in to the authorities on Thursday. They now face charges of first-degree murder. Additionally, Carlishia has been charged with contributing to the delinquency of a minor. During their court appearances, Carlishia’s bond was set at $3 million, and she is scheduled to return to court on July 12. Meanwhile, her son was ordered to be held without bail and is expected to appear in court on July 25th. Enugu Tribunal orders Peter Mbah to appear before it over alleged NYSC certificate forgery
The Enugu State Governorship Election Petition Tribunal has ordered Governor Peter Mbah to appear before it tomorrow, Friday, over the alleged forgery of the National Youths Service Corps, NYSC, discharge certificate. This is coming after an application was made by the candidate of Peoples Redemption Party, PRP, Elder Christopher Agu through its counsel, Barr Alex Amujiogo, claiming that Mbah was not qualified to contest the election.
Present Enugu Governor, Peter Mbah At the resumed hearing, the PRP’s counsel, Amujiogo told the tribunal that Mbah was supposed to be in court as a subpoenaed witness. He, however, said from the affidavit deposed to by the bailiff of the Tribunal, it had been difficult to serve Mbah the summon. Amujiogo then moved an application, urging the Tribunal to grant a substituted service of the summon on Mbah through his counsel. Although the application was opposed by the three respondents, the INEC, Mbah as well as the Peoples Democratic Party, PDP, on the grounds that it was supposed to come by way of motion, supported by an affidavit during pre-trial session, they were overruled by the Tribunal. Chairman of the Panel, Justice K. M. Akano ordered that the subpoena be served on Mbah through his counsel and that he should appear before the Tribunal tomorrow, June 23, 2023. Earlier, the PRP guber candidate during the election, Agu, had also testified before the Tribunal as PW2. An official of the NYSC from the National Secretariat, Abuja, Barr. Aliu Muhammed, who also appeared on behalf of the Director-General of the Corps, tendered an affidavit to the Tribunal, declaring that an order of a Federal High Abuja, was inhibiting them from tendering the disclaimer the Corps made against Mbah’s certificate. The PRP lawyer, Amujiogo told journalists after the Tribunal’s sitting that “our PW2 (Christopher Agu) has already testified before the Honourable Tribunal and he has given a clearer picture, the synopsis of what transpired during the election and we are urging the Tribunal to set aside the purported result in favour of Peter Mbah, the Governor. “We had an issue of subpoena against Barr Peter Ndubuisi Mbah, in which the Tribunal is urging him to appear before it to clarify certain issues against him, based on his NYSC certificate and other matters. “Surprisingly, he was not in the Tribunal today and the bailiff informed the Tribunal that he is invading service, he cannot find him, the security cannot allow him to serve Mbah the subpoena. “Then, the Tribunal in its own wisdom, after I have applied, has now permitted the bailiff or myself, to now serve Mbah through his counsel, for him to appear before the Tribunal tomorrow, being 23rd of June, 2023 and clarify certain issues against him before the Tribunal and we have already served him the said subpoena through his lawyer, Ik Onuoma today in court. “So he must obey the summon of the Tribunal by appearing in person tomorrow, Friday.”

Orezi reacts as IGP orders immediate arrest of Seun Kuti
Singer Orezi has expressed shock and has reacted to the order of the Inspector General of Police (IGP) for the immediate arrest of Seun Kuti. In the late hours of yesterday, May 14th, video footage of famous singer and political activist, Seun Kuti assaulting a policeman on the streets of Lagos.
