73-year-old man arrested by EFCC regains freedom after awaiting trial for 13 years

A 73-year-old man, identified as Nyeche, who was arrested by the EFCC, has been released from prison after enduring 13 years and eight months of detention without trial. The old man’s ordeal began when he was arrested by the Economic and Financial Crimes Commission (EFCC) at the age of 60, sparking concerns over the protracted and seemingly unjust nature of his detention. The Headfort Foundation, a human rights group, played a pivotal role in securing Nyeche’s release. The organization revealed that they became aware of his situation through a church member who participated in a prison outreach in March 2022.

Disturbed by the circumstances surrounding Nyeche’s case, the foundation decided to intervene and champion his cause. According to a statement released on the Headfort Foundation’s Twitter page, they discovered that Nyeche’s case file had gone missing and that he had not been presented before any court between 2019 and 2023. The foundation tracked down the missing file to the office of the Director of Public Prosecutions (DPP), and on October 20, 2023, brought Nyeche before the court, where he was re-arraigned for the crime of stealing. Arguing on behalf of Nyeche, the Headfort Foundation contended that he should be released, highlighting that he had already spent more time in prison than the stipulated sentence for the crime of stealing if found guilty. However, the EFCC requested an adjournment to prepare for trial, a request that the court granted. Undeterred, the foundation’s legal team promptly applied for Nyeche’s bail, assuring the court that they would ensure his presence on the next adjourned date. The court, considering the merits of the application, granted bail to Nyeche on the condition that the foundation ensures his appearance in court for the upcoming proceedings. Finally, on October 20, 2023, after enduring over a decade of incarceration, Pa. Nyeche experienced the sweet taste of freedom. “Nyeche, a 73-year-old man, was arrested by EFCC at the age of 70 sic (60), he spent 13years and 8months in prison awaiting trial. We took on his case after being referred by a church that went for prison outreach in March 2022. His case file went missing and he was not before any court between 2019 and 2023. We traced his file to the DPP office and brought him before a court on 20th October 2023 when he was re-arraigned for the crime of stealing. We argued that Nyeche should be released because he has already served more than the provided sentence for the crime of stealing if found guilty. On the other hand, the EFCC requested an adjournment to prepare for trial and the court granted same. Then our lawyer applied for his bail and undertook to ensure his presence in court on the next adjourned date. The court granted our application on the ground that we ensure his presence on the next date. “Finally, on the 20th October, 2023, Pa. Nyeche experienced freedom after 13years and 8months in prison. The duo was found in possession of drugs valued at over N63 million. The arrests followed a careful operation by law enforcement authorities, who seized a total of 65 grams of Mephedrone (MD), a potent synthetic drug, along with a substantial amount of cash, totaling Rs 65,000.

Additionally, a digital weighing machine was confiscated from the accused, suggesting their involvement in drug distribution. The estimated value of the seized narcotics is approximately Rs 6 lakh, according to the police. This significant quantity of Mephedrone, also known as MD or “Meow Meow,” is known for its stimulant and psychoactive properties and is considered a controlled substance in many countries, including India. Pushkar police station in-charge, Rakesh Yadav, confirmed that a case has been registered against both Adaeze Jaye and Success Chamika under the Narcotic Drugs and Psychotropic Substances (NDPS) Act. The statement reads: “We wish to alert the Nigerian public that at about 9:44 pm on Sunday, 23 July, 2023 a man seeking to confirm the residence of His Excellency Atiku Abubakar in Yola was apprehended at the gate of the residence. “The man who was apprehended by security operatives at the residence of Atiku Abubakar was later handed over to the police. “Upon further interrogation by the Police, the suspect identified himself as a 29 year-old Jubrila Mohammed and confessed to being a Boko Haram member from Damboa in Borno State. “The suspect also informed the Police that he and his colleagues, who were later arrested too, intended to attack organisations associated with Atiku Abubakar and some other sensitive locations in Yola. “All four suspects have been handed over to military authorities. We commend the police for the work that they continue to do in this particular investigation. “We further ask that other relevant security agencies remain on top of their brief.”

He told newsmen in Yola on Tuesday that Blessing who resides in Jambutu area of Yola North Local Government Area, had however denied killing the baby, claiming that it was delivered prematurely. “I had a safe and peaceful delivery but the baby was lifeless hence my decision to dump it in the dustbin. “When I discovered that it was a stillbirth, I kept the corpse for two days before I dumped it in the dustbin and even my aunt whom I have been living with did not know that I was pregnant for nine months,” she told newsmen. The police spokesman said that the suspects would be arraigned in court upon completion of the investigation. In other news, a four-day-old child survived a terrible tragedy that occurred during a family’s first night in their new home in Nkwelle Ezunuka, Oyi Local Government Area, near Onitsha, claiming the lives of Ifeanyi, his wife Amaka, their two children, Amaka’s mother, and an apprentice, due to poisonous fumes from a generator, leaving only their four-day-old baby as the sole survivor. The incident happened on Thursday night, July 20, 2023. The family was happy and celebrating in their new house when suddenly the electricity went off. To keep the celebration going, Ifeanyi quickly set up a generator outside the bedroom. As the night went on, the family went to sleep without turning off the generator. Sadly, the fumes filled the house while they slept, and they couldn’t wake up the next morning. A friend who was supposed to join them that night went to their house but found the doors locked and the generator still running. The friend alerted other neighbours, and they forced open the door. Inside, they found the family unconscious. Tragically, Ifeanyi, Amaka, their children, and Amaka’s mother had already passed away. The apprentice was also among the deceased.

On Monday, the pupils, ages 13 and 15, from JSS 3 and SSS 1 courses, confessed to the crime at the state headquarters of Amotekun Corps in Akure, the state capital. The children, who are siblings, said they meant to act to retaliate against their mother, whom they accused of mistreating them. The Commander of Amotekun Corps, Adetunji Adeleye, stated at the corps’ headquarters that an inquiry has commenced to determine the motivation for the siblings’ actions. He further stated that 28 other individuals were apprehended from other parts of the state. He said that the arrest was made possible by a joint patrol of his troops, the military, and other security organizations. “This is in continuation of our efforts to ensure that kidnapping in Ondo State becomes a thing of the past. We have people who kidnapped themselves and raised alarm, and in our diligent investigations, we were able to unravel the mystery surrounding the disappearance to the extent that they confessed.
