Seun Kuti's lawyer tackles police, ask them to stop keeping his case file

Fusika who accused the police of parading his client at every police station in the state, said they are waiting for him to be charged so they can offer his defence.

It is the police who, rather than taking this simple and straightforward step, have decided to create a circus and make a ‘national emergency’ of the matter. “Now that Mr Kuti has been put in manacles and taken on parade from one police station to another and from one location to the other across Lagos State since Monday, May 15, when exactly is he going to be charged for, as you put it in your statement, ‘attacking and slapping a police officer in uniform?’ “That should not be too much for a suspect to expect. I do hope that Lough as a lawyer and indeed a Senior Advocate of Nigeria counselling the police on this matter will obey the order of the magistrate’s court to send the case file to the Lagos State Director of Public Prosecutions for legal evaluation and possible charge and prosecution before a court of law.”

He has since been in police custody even though a magistrate court in Lagos granted him bail hours after his arrest. In a post via Twitter, Reno Omokri condemned Seun’s act, however, justifying it with PTSD due to childhood of the singer.

Omokri on PSTD claims “What Seun did was wrong. And I condemn it. But Seun has a history with the police and the military that has scarred him for life. They beat his Septuagenarian grandmother and threw her from the first floor to the ground. She died from the injuries sustained. His father carried her coffin to Dodan barracks in tears! Till today, NOBODY was punished for the crime against Olufunmilayo Kuti. They beat his father to an inch of his life. Multiple times. They burnt down their residence, with multiple vets and other property. They were never paid compensation. The police raided the shrine episodically, right from when Seun was a baby to his adulthood. And even in this incident involving the slap, there was provocation from the policeman. I am not saying that the provocation justified the slap. My motive is just to put things in context. What he did was condemnable. It is unacceptable. But when you look at his personal history, there are mitigating circumstances. And I beg the Inspector General of Police to take Seun’s Post Traumatic Stress Disorder into account. Because even Buhari’s wife, Aisha, admitted that her husband also suffers from PTSD due to his experience with the Nigerian state apparatus. The police is as institutionally to blame for what happened to that policeman as Seun. Let us do story here and not just justice.” What Seun did was wrong. And I condemn it. Nigerian Police allegedly asks court for 21 days to detain Seun Kuti

The Lagos State Police Command has asked Court to remand Seun Kuti for 21 days in detention as the police officer he slapped is allegedly in coma at an undisclosed hospital. A source disclosed to SaharaReporters that Seun Kuti was secretly arraigned without notifying his lawyers at the Yaba magistrate court.

“The police have moved Seun Kuti to the Yaba Magistrate Court for arraignment without notifying his lawyers. The magistrate is sitting by 12noon, but Seun and his lawyers are already in court,” the source said. According to SaharaReporters, a witness in the court said; “The Chief Magistrate Mrs, Adeola Olatunbosun Magistrate Court 1 Yaba took a statement from the Nigerian police applying to detain Seun Kuti for 21 days, claiming the policeman he allegedly assaulted is in a coma at an undisclosed hospital. However, Kuti’s lawyer, Adeyinka Olumide-Fusika countered that the police already stated publicly that the police officer trailed and went to Seun’s house and accepted N12,000 to repair his car. It also emerged that the DCP in Panti had gone to meet the Magistrate earlier before secretly moving Seun to the court without notifying his lawyer. They also accused Seun of not writing a statement, but Olumide-Fusika countered that he was there when Seun wrote a statement. The Chief Magistrate decided to go on recess to ‘study the file.” Seun Kuti, who spoke through his lawyer, Olumide Fusikan, SAN said that he would defend himself against Hundeyin’s investigative findings at the right time. Kuti turned himself in on Monday following the allegation that he assaulted a Police officer in a video making its rounds on social media.
