Mr Dele Alake, Presidential Adviser on Special Duties, Communications and Strategy, made this known at a briefing on Thursday in Abuja.

The new orders affected the Finance Act 2023, the Customs, Excise Tariff and the Excise Tax on telecommunications as well as the Green Tax. “The Finance Act (Effective Date Variation) Order, 2023, has now deferred the commencement date of the changes contained in the Act from May 23, 2023 to September 1, 2023. This is to ensure adherence to the 90 days minimum advance notice for tax changes as contained in the 2017 National Tax Policy. “The Customs, Excise Tariff (Variation) Amendment Order, 2023. This has also shifted the commencement date of the tax changes from March 27, 2023 to August 1, 2023 and also in line with the National Tax Policy. “The President has given an Order suspending the 5% Excise Tax on telecommunication services as well as the Excise Duties escalation on locally manufactured products. “Further to his commitment to creating a business-friendly environment, the President has ordered the suspension of the newly introduced Green Tax by way of Excise Tax on Single Use Plastics, including plastic containers and bottles. “In addition, the President has ordered the suspension of Import Tax Adjustment levy on certain vehicles,” he said. Tinubu said that the review was part of his administration’s resolve to ease the lives of Nigerians and encourage corporate entities in spite of obvious challenges. The president said that the reviewed tax were part of those signed in the twilight of the last administration. “You will all recall that prior to the advent of this Administration, certain tax changes were introduced via the Customs, Excise Tariff (Variation) Amendment Order, 2023 (henceforth referred to as “the Order”) published on May 8 and the Finance Act, 2023, which was signed into law on May 28. “Among others, the Order introduced new Excise Duty on Single Use Plastics (SUPs), higher Excise Duties on some locally manufactured products, including alcoholic beverages and tobacco products, and Green Tax by way of Import Tax Adjustment on certain categories of imported vehicles. “The Tinubu Administration has since noticed that some of the tax policies are being implemented retroactively with their commencement dates, in some instances, pre-dating the official publication of the relevant legal instruments backing the policies. This lacuna has created some challenges of implementation.” He said that the ideas behind upward adjustments of some of these taxes are quite noble because they were designed to raise revenue as well as address environmental and health issues of concern. “However, they have generated some significant challenges for, and elicited serious complaints amongst key stakeholders as well as in the business community. “A document known as the 2017 National Tax Policy approved by the Federal Executive Council of the last administration prescribes a minimum of 90 days notice from government to tax-payers before any tax changes can take effect. “This global practice is done with a view to giving taxpayers and businesses reasonable time to adjust to the new tax regime. “However, both the Finance Act 2023 and the Customs, Excise Tariff Order 2023 did not give the required minimum notice period, thus putting businesses in violation of the new tax regime even before the changes were gazetted. “As a result of this, many affected businesses are already contending with the rising cost, falling margins and capacity underutilisation due o various macroeconomic headwinds as well as the impact of Naira redesign policy.” He stated that the Excise Tax increases on tobacco products and alcoholic beverages from 2022 to 2024, which had already been approved, are also being implemented. “But a further escalation of the approved rates by the current administration presents an image of policy inconsistency and creates an atmosphere of uncertainty for businesses operating in Nigeria. “The Excise Tax of fiver per cent on telecommunication services has generated heated controversy. “There is also a lack of clarity regarding the status of this tax, just as players in the sector also complain about the imposition of multiple taxes on their operations. “We have also seen that the Green Taxes, including the Single Use Plastics tax and the Import Adjustment Levy on certain categories of vehicles require more consultation and a holistic approach to the country’s net zero plan in a manner that does not impact the economy negatively.” The News Agency of Nigeria (NAN) report that in his inaugural speech, Tinubu promised to address business unfriendly fiscal policy measures and multiplicity of taxes. These new orders were issued to ameliorate the negative impacts of the tax adjustments on businesses and chokehold on households across affected sectors. Tinubu reiterated his commitment to reviewing complaints about multiple taxation, local and anti-business inhibitions. “The Federal government sees business owners, local and foreign investors as critical engines in its focus on achieving higher GDP growth and appreciable reduction in unemployment rate through job creation. “The government will, therefore, continue to give requisite stimulus by way of friendly policies to allow businesses to flourish in the country.” He assured Nigerians that there would not be further tax raise without robust and wide consultations undertaken within the context of a coherent fiscal policy framework.

President Bola Tinubu, vice president Kashim Shittema and the All Peoples Congress (APC) on Wednesday closed their defence in Mr Peter Obi and his Labour Party’s petition. Counsel for Tinubu and Shettima, Wole Olanipekun, SAN informed the presidential election petition court (PEPC) that they are closing their case after the testimony of their sole witness.

President Bola Tinubu flanked by VP Kashima Shettima and supporters Lateef Fagbemi, SAN for APC also informed the court that they have no witnesses and relied on the witnesses called by other respondents. Following the closure of their defence the five-member panel presided over by Justice Haruna Tsammani said the date for the final written addresses would be communicated. Tsammani assigned 10 days each to the respondents, seven days to the petitioners and five days for reply. Earlier, Tinubu through his counsel tendered some documents in support of their defence. The documents tendered are a letter from the Nigeria Police to the United States Embassy, dated February 3, 2003; letter from the United States Embassy to the Nigeria Police, dated February 4, 2003. Others are; US Visas and immigration documents between 2011 and 2021.
Others are; A copy of the Report of the Committee on the Location of the Federal Capital of Nigeria, certified by the Archives and History Bureau of the FCT. Tendered also are copies of Form EC 8D for Kano State in respect of the February 25, 2023, presidential election; and copies of Form EC 8D(A); copies of Form EC8D in respect of the presidential election of 25th February 2023. Also tendered and admitted were a list of registered members of the labour party and a membership list of LP for Anambra state to claim that Obi is not a member of the labour party. After the tendering of documents, Olanipekun called their sole witness, Senate Majority Leader Sen. Michael Bamidele to testify. Being cross-examined by Fagbemi, the witness told the court that the February 25 presidential election results for APC in Kano state were recorded with a shortfall of 10, 292 votes against Tinubu. He added that Obi‘s name was not contained in the membership list of the LP submitted to the INEC. Being cross-examined by counsel to Obi, Dr Livy Uzoukwu, SAN the witness agreed that there a report by the EU election observers in Nigeria and it was tendered through him in evidence. On whether the letter from the United States Embassy to the Nigeria Police, dated February 4, 2003 addresses issues of criminal allegation against Tinubu, the witness said the Nigeria Police letter to the US requested for search for general Criminal records against Tinubu.. He added that therefore the US letter which cleared Tinubu of criminal conviction was an appropriate response. Abubakar Mahmoud, SAN counsel for INEC told the court that they have no cross-examination. We’ve to make sacrifices and that is clear. “But Allah will not give you the burden that you cannot carry; He will not. He is there for you. “Have faith in the country, have faith in yourselves, believing as a citizen of this country that it will be well with us. “You must join hands to live together without religious or tribal sentiments. Live with one another in joy and prosperity. “Nigeria will see peace and stability and God will grant those in the warfront victory and peace and spare their lives.” In his sermon, the Chief Imam of Lagos, Sheikh Suleiman Abu-Nolah, said that the festivity promotes the culture of sacrifice, unity and tolerance among the Muslim faithful. “The religion does not permit the practice of selfishness, intolerance or sectionalism. “We should use the occasion to reflect on the various challenges facing the country and use it to rectify whatever is our challenge through prayer to God Almighty.” The Chief Imam prayed for the continued peace, progress and stability of Nigeria and called on all Nigerians to imbibe the values of Prophet Ibrahim. Mr Femi Hamzat, Deputy Governor of Lagos State, urged Nigerians to continue to pray for the wellbeing of the country. “We must sacrifice for the nation because praying and loving is part of our duty as citizens because it is what will make the nation great,” he said. Gbajabiamila, in his speech, said that the president would continue to give hope to Nigerians by continuing to implement people-oriented policies. He said that the president would need the prayers of Nigerians to continue the various initiatives towards turning the country into the dream of our founding fathers. “As the president returns Abuja, he will need your prayers and as he moves to all the nooks and crannies of Nigeria, he will also need your prayers. “The weight of the task is daunting but with the prayers and support of all Nigerians, the president will surely surmount them,” he said.

Muhammadu Buhari, the immediate past president of Nigeria Monday revealed why he left his successor, Bola Tinubu to remove fuel subsidy, saying that had the policy been implemented, the All Progressives Congress (APC) and Tinubu would have lost the last general polls. Buhari’s former aide, Garba Shehu, via a statement, said the ex-president commended the steps taken so far by the new administration in implementing the removal of petrol subsidy and attempt to unify the Naira exchange rate.

According to him, successive polls indicated that the ruling party would have lost the 2023 election if the Petroleum Industry Act, containing the petrol subsidy removal, was implemented before then. In the statement titled “Buhari didn’t fail to remove subsidy “, Shehu wrote: “Why did it take the new Tinubu/ Shettima presidency weeks to remove the petrol subsidy when Buhari didn’t do so for years fails to ask the right question. “The massive electricity subsidy. The fraudulent fertilizer subsidy. Hajj/Christian Pilgrim subsidies. Remember them? “The diesel subsidy. The aviation fuel subsidy. LPFO. Kerosene. Cooking gas and the other subsidy policies we found in place and put them firmly on the ground. Remember them? “For those with short memories, many of those subsidies were all in place when President Buhari was elected to office in 2015: all those in place were gone by May 2023 – including the annual fertilizer subsidy that weighed 60-100 billion Naira (that’s trillion naira in about 10 years – yes you read that right) heavy on the federal budget each year. “So no, Buhari didn’t remove the petrol subsidy – but in vitally important stages he removed every other budget-busting, egregious, economic-growth-crushing subsidy along the way. “So far I have refrained from answering these repeated questions on the removal in Nigeria of subsidies on Premium Motor Spirit, PMS and that arising from the dual rates of the Naira in the Central Bank and the parallel market: Why did Buhari ‘fail’ to do these? “First of all, my thinking is that instead of the former President answering this question, it is the Party, the All Progressives Congress, APC that is best suited to speak and failing to do this, we are forced to say what will follow here. “Secondly, we are mindful of the fact that with a Tinubu/Shettima presidency now in place and for which there is a ‘New Sheriff in Town’. “We do not want to distract them from the onerous tasks facing them and the nation. Neither is it our wish to take the spotlight away from them in any way. “In terms of the timings of the decisions to remove fuel subsidy and unify the currency, the Tinubu/Shettima administration has done overwhelmingly well. Even more importantly, they have been most dexterous in managing the aftermath of the decisions by successfully avoiding any crisis. “To this extent, our wish and prayers are that fellow countryman will continue to support the new leadership in these very laudable decisions and, in particular, for the Labour leadership and civil society to work with them to ensure that the palliative efforts as promised are successfully implemented. “The decision to remove subsidies, as in our case – and we believe in all situations – was not for the President to take all by himself. “That’s why it’s important to remind ourselves – and all those who have conveniently forgotten – that Buhari administration had been on this pathway from the very beginning in 2015. “Removing subsidies for the Naira and PMS was cued and put on hold. Look for example in the Petroleum Industry Act. The important decision was kept for a better time. “It could not have come at a time when tensions were high in the country and no responsible leader would have added fuel to the fire. “In the view of many-including those in the security circles- only a new administration with a goodwill that fills a warehouse can attempt this, and here now comes in the wit and grit of the Tinubu government. “Finally, we must be politically honest with ourselves. The Buhari administration in its last days could not have gone the whole way because the APC had an election to win. And that would have been the case with any political party that was seeking election for another term with a new principal at its head. “Poll after polls showed that the party would have been thrown out of office if the decision as envisaged by the new Petroleum Industry Act was made. “With the election now behind us, a capable leader as we now have in place is best positioned to move forward. We have nothing but confidence that the new administration will carry the nation and all its constituents into a stable future in the aftermath of these major economic and financial decisions. “As they say, there are times when you have to lose in order to win.”
